Both of these terminations are in the process of being Appealed. Attorneys Eric Hessler (FOP) and Frank DeSalvo (PANO) are filing a Motion for Summary Judgement in the Keller matter, and if that is unsuccessful, the case will likely be heard by Civil Service on October 15, 2009.
The Lapene matter will be heard October 8, 2009. Both will be heard in the Civil Service chambers on the 7th floor of City Hall on the respective dates, unless continued for some reason. The hearings are open to the public and I recommend you attend, not only to support these fine, unjustly punished officers, but to see first-hand, the cavalier manner in which PIB bends and misrepresents the truth, mischaracterizes the events, and omits and edits their final report to reflect the outcome they desire. Anyone whose ever had to deal with PIB knows this. The only crooks in the department are the ones allegedly entrusted to find cops breaking the law. They should look in a mirror and they'd clean out the biggest nest of them in the department.
